Austin, TX Expungement Lawyer

A Texas criminal record can make it much more difficult to find a new or better job, get approved for a mortgage, or move into an apartment that does background checks. It even makes it more difficult to get professional licenses and adopt children.

What many people don’t realize is that even if their criminal charge was dismissed, it still shows on their criminal arrest records. This is where an Austin expungement lawyer can make a world of difference.

What is Expungement?

Expungement, also known as expunction, is a legal process that allows deserving Texans to clear Austin criminal charges from their arrest records.

For a comprehensive overview, see the Texas expunction statute here or read our Texas Expungement Guide.

What is an Order of Nondisclosure?

Similar to expungement, an order of nondisclosure is a legal process that allows a person to seal certain criminal records. Under an order of nondisclosure, only certain State agencies can see the records. These agencies are ordered to seal the records and to not disclose them to private entities. This keeps employers, lenders, and the general public from being able to see that a charge was ever filed.

For a comprehensive overview, see the Texas nondisclosure statute here or read our Texas Nondisclosure Guide.

How Does Expungement & Nondisclosure Work in Austin and Travis County?

An expunction In the Travis County Court system typically starts with your Austin expungement lawyer filing a civil lawsuit called a “petition for expunction of criminal records.”

The petition is filed with the Travis County District Clerk’s office in Austin. The petition asks the court to order certain state agencies to destroy or seal their records regarding your criminal charge.

After the petition is filed with the Travis County Clerk and the filing fee is paid, the Travis County District Attorney’s Office Expunction Division will be notified and served with your petition. They will have a change to oppose your petition but sometimes choose not to.

Whether your petition is opposed or not, the court will schedule a hearing for to rule on your case. At this hearing, the court will decide whether to grant your petition. If the petition is granted, your expungement lawyer will file the judge’s order with the court clerk to file and serve it upon every State agency we think has records of your arrest.

What Will an Austin Expungement Lawyer Do for You?

#1. Determining Your Eligibility

The is the most important step. Your expungement attorney will do the legal research and other legwork to determine if you’re eligible for expunction or nondisclosure. This service that can save you time and money. If you are not eligible for expunction or nondisclosure and file your petition anyway (or if you file the wrong petition), you could lose your case and your entire filing fee, which could easily be several hundred dollars.

#2. Draft & File Your Legal Documents

After finding out if you’re eligible to clear your record, your Austin expungement/nondisclosure attorney will draft the required legal documents. Once the documents are drafted, they will be filed in the appropriate court.

#3. Properly Serve Important State Agencies

Even after the court grants your petition for expunction of criminal records, your case is not over. The order needs to be served upon various state agencies so they can know they are supposed to seal or destroy your records. Your expunction attorney will serve all of the necessary parties to make sure all records are properly handled.
